Terms of Service

Last updated: September 30, 2026

These Terms of Service (the "Terms") are a binding agreement between you and Sendar ("Sendar", "we", "us"), the operator of the sendar.app website, dashboard, email-sending APIs, and Sendar-provided agent integrations (collectively, the "Service"). By creating an account or using the Service in any way, you agree to these Terms, our Acceptable Use Policy, our Privacy Policy, and, where it applies to you, our Data Processing Addendum, each of which is incorporated into these Terms by reference.

If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to it. If you do not agree to these Terms, do not use the Service.

1. The Service

Sendar provides an API and dashboard that let you send transactional and product email from domains you own and have verified with us, along with supporting features such as email logs, scheduled sending, attachments, webhooks, API keys, usage metrics, and documentation. Sendar is a sending platform: we are not a mailbox provider, and we do not offer inboxes or receive mail on your behalf.

The Service also includes communications from us to you, such as verification emails, billing receipts, service and security notices, and messages from our team in the Messages section of your dashboard. These operational communications are part of the Service and are not marketing.

2. Agent Integrations and Authorized Automation

You may use Sendar through compatible skills, plugins, MCP clients and other integrations. A marketplace listing or client display name is not a guarantee of the third party's identity, security or compatibility. Review the permissions shown by Sendar before authorizing a connection.

OAuth connections provide read access by default. Sending requires separate authorization and the applicable verified-domain, recipient, connection and plan limits. An API key is a separate credential with its own permissions; keep it private and out of prompts, public repositories and client-side code.

Only authorize actions and sharing you have the right to perform for your workspace and recipients. Check the recipient, sender, subject and content before approving a send, or define clear limits for an automated sending task. You remain responsible for messages sent on your behalf, recipient permissions and compliance with our Acceptable Use Policy. AI-generated content may contain errors and should be reviewed for the intended use.

A preview does not send email or establish delivery readiness. A provider's acceptance of a message does not guarantee inbox delivery. Reuse the same idempotency key when retrying an agent send; after an uncertain result, check message history before initiating another send.

Revoke OAuth access in Agent connections and API keys in API Keys. Revocation prevents new requests using that credential, but does not undo completed actions or automatically cancel mail already accepted for scheduled delivery. Review and cancel scheduled messages separately where cancellation is still available. Third-party AI services are governed by their own terms and privacy policies.

3. Accounts and Eligibility

You must be at least 18 years old to use the Service. When you create an account you agree to provide accurate, complete registration information and to keep it up to date. You are responsible for safeguarding your password and API keys, and for all activity that occurs under your account, including requests authenticated with your API keys. Notify us immediately if you believe your credentials have been compromised.

Certain features — including creating API keys and adding sending domains — require you to first confirm your email address. You may only register domains that you own or are authorized to use, and you may not create multiple accounts to evade quotas, suspensions, or other limits.

4. Free Plan

We offer a free plan with limited monthly and daily sending volume, and limits on domains and other resources, as described on our Pricing page. The free plan is provided for genuine evaluation and low-volume use. We may change free plan limits, or withdraw the free plan, at any time; if we do, we will apply changes prospectively and communicate material changes to affected accounts.

5. Paid Plans and Billing

Paid plans are billed in advance on a recurring monthly or yearly cycle and renew automatically until cancelled. Payments are processed by PayPal, including card payments made through the secure card fields in our checkout: your full card details are collected directly by PayPal and never touch Sendar's servers. We retain only the card brand and last four digits so you can recognize the card on file, together with transaction records.

By subscribing, you authorize us (through our payment processor) to charge your saved payment method the applicable fees at the start of each billing cycle. A receipt is emailed to you for every successful charge. When you switch to a different plan, the new plan is charged immediately and replaces your current plan without proration of unused time, except that resubscribing to the same plan you already have keeps your existing paid-through date and schedules your next charge for when it ends.

6. Fee Changes

We may change our fees from time to time. Price changes for existing subscriptions take effect at the start of a subsequent billing cycle, and we will give you reasonable advance notice — at least 30 days — by email or through the dashboard. Your continued use of a paid plan after a price change takes effect constitutes your agreement to pay the updated amount. If you do not agree, cancel before the change applies.

7. Failed Payments

If a renewal charge fails, we retry it over the following days (declines are retried a limited number of times, spaced roughly 12 hours apart; temporary processing errors do not count against those attempts). Your plan continues during a short grace period while we retry. If payment still cannot be collected, your subscription is cancelled and your account moves to the free plan, with free plan limits applied. We will email you when a renewal fails so you can update your payment method or resubscribe.

8. Cancellation and Refunds

You can cancel your subscription at any time from Settings → Billing. Cancelling turns off auto-renewal: your paid plan and its limits remain active until the end of the period you have already paid for, after which your account moves to the free plan. We do not delete your account or data when a subscription ends.

Except where required by applicable law, fees are non-refundable and we do not provide refunds or credits for partial billing periods or unused sending volume. If you believe you were charged in error, contact support@sendar.app and we will review it.

9. Quotas, Rate Limits, and Fair Use

Each plan includes sending quotas (such as monthly and, on some plans, daily email volume) and resource limits (such as domains and webhook endpoints), as described on the Pricing page and in your dashboard. Requests over a quota are rejected with an error. We also apply technical rate limits and may queue, pace, or temporarily throttle sending to protect the stability of the platform and the deliverability of all customers, since sending infrastructure is shared. Deliberately structuring your usage to evade quotas or limits is prohibited.

10. Your Content

You retain all rights to the content you submit to the Service — including recipient lists, subject lines, message bodies, and attachments ("Customer Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, and transmit Customer Content solely as needed to provide the Service (for example, to deliver your emails, show your email log, and operate abuse prevention), consistent with our Privacy Policy and Data Processing Addendum. We do not sell Customer Content and we do not use it to advertise to your recipients.

You are solely responsible for Customer Content: for having the legal right to send it, for obtaining any consents required from recipients, and for its accuracy and legality. We may remove or refuse to transmit content that violates these Terms or the Acceptable Use Policy.

11. Acceptable Use

Your use of the Service must comply with our Acceptable Use Policy, which is part of these Terms. In short: send only to recipients who have given you permission, identify yourself honestly, honor unsubscribe requests, and never use Sendar for spam, phishing, malware, or other abusive or unlawful mail. You must also comply with all laws that apply to your sending, including anti-spam and data protection laws such as CAN-SPAM, CASL, the GDPR and ePrivacy rules, and POPIA, as applicable to you and your recipients.

12. Prohibited and Unlawful Uses

Without limiting the Acceptable Use Policy, you agree not to use the Service, directly or indirectly, to:

  • Violate any applicable law or regulation, or promote, facilitate, or conceal any illegal activity.
  • Defraud, deceive, or mislead anyone — including phishing, credential harvesting, forged invoices or notifications, advance-fee and prize scams, and impersonation of any person, brand, bank, or government body.
  • Transmit or link to malware, ransomware, spyware, or other harmful code, or operate supporting infrastructure such as botnet command-and-control.
  • Advertise or facilitate the sale of illegal goods or services — including illegal drugs, prescription drugs without a valid prescription, illegal weapons or explosives, counterfeit goods or currency, stolen property or data, and forged documents or IDs.
  • Exploit, endanger, or sexualize minors in any way — child sexual abuse material is terminated and reported to the authorities without exception.
  • Promote, finance, or facilitate terrorism, violent extremism, human trafficking, or violence or hatred against any person or group.
  • Engage in money laundering, money-mule recruitment, Ponzi or pyramid schemes, securities fraud, or deceptive investment or cryptocurrency promotions.
  • Threaten, extort, harass, stalk, or doxx anyone, or unlawfully surveil or intercept communications.
  • Infringe intellectual property or other proprietary rights, or distribute pirated content or circumvention tools.
  • Interfere with or disrupt the Service, probe its security, or attempt unauthorized access to any account, system, or data.

The detailed catalogue of prohibited content, restricted industries, and sending practices is in the Acceptable Use Policy. We may investigate suspected violations, preserve related records, and report unlawful activity to law enforcement, as described in our Privacy Policy.

13. Sanctions and Export Compliance

You represent that you, your organization, and its beneficial owners are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to a comprehensive embargo, and are not identified on any applicable sanctions or denied-party list (including United Nations, EU, UK, and US OFAC lists). You may not use the Service for the benefit of any sanctioned person or territory, to facilitate transactions prohibited under applicable sanctions, or in violation of export-control laws. We may suspend or terminate accounts where required to comply with these laws.

14. Suspension

We may suspend sending for your account if we reasonably believe your use violates these Terms or the Acceptable Use Policy, creates risk for the platform, other customers, or recipients, is connected to non-payment, or is required by law. Our systems monitor sending patterns for abuse signals, but flags raised by automation are reviewed by a person before we suspend an account — suspension decisions are made by humans.

While suspended, sending through the API and dashboard is blocked, and queued or scheduled mail is held (it is delivered if the suspension is lifted). You can still sign in, read the suspension notice in your Messages inbox, and reply to us there. Where practicable we will tell you the reason and give you an opportunity to resolve it.

15. Termination

You may stop using the Service at any time and may delete your account in Settings. Account deletion is immediate and permanent: your domains, API keys, email logs, attachments, webhooks, and messages are removed as described in our Privacy Policy, and any active subscription's auto-renewal is cancelled. Deleting your account does not entitle you to a refund of fees already paid.

We may terminate your account for material or repeated breach of these Terms, prolonged non-payment, extended inactivity of free accounts, where required by law, or if we discontinue the Service (in which case we will give reasonable notice). Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) survive.

16. Intellectual Property and Feedback

The Service — including our software, APIs, documentation, design, name, and logos — is owned by Sendar or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use the Sendar name or logos without our prior written consent, except to truthfully state that you use the Service.

If you send us feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

18. Third-Party Services

The Service depends on third-party providers — for example, Oracle Cloud Infrastructure transmits email on our behalf, PayPal processes payments, and Google provides optional sign-in. Their services are governed by their own terms and privacy policies, and we are not responsible for them. The Service and our website may also contain links to third-party sites we do not control; we are not responsible for their content or practices.

19. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY EMAIL WILL BE DELIVERED TO, OR PLACED IN THE INBOX OF, ANY RECIPIENT.

Email delivery ultimately depends on recipient mail systems, spam filters, DNS configuration, and other factors outside our control, and no sending platform can guarantee inbox placement. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENDAR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE DURING THAT PERIOD (OR, IF YOU HAVE PAID NOTHING, USD $50). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you; nothing in these Terms excludes liability that cannot be excluded under applicable law.

21. Indemnification

You will defend, indemnify, and hold harmless Sendar and its personnel from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) Customer Content, including the recipients you choose and the consents you did or did not obtain; (b) your use of the Service in violation of these Terms, the Acceptable Use Policy, or applicable law; or (c) your violation of any third-party right.

22. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Botswana, without regard to conflict-of-law rules, and the courts of Botswana have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where the law of your country of residence grants you mandatory protections or venue rights that cannot be waived. Before starting formal proceedings, you agree to first contact us and give us a good-faith opportunity to resolve the dispute informally.

23. Changes to the Service and These Terms

We are continuously improving the Service and may add, change, or remove features. We may also revise these Terms from time to time. If a change is material, we will give notice before it takes effect — by email, through the dashboard, or by updating the "Last updated" date on this page with reasonable advance posting. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

24. Miscellaneous

  • Entire agreement. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary and the rest remains in effect.
  • Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
